FUGITIVE Nicholas Rossi CAN be returned to America to face rape charges a court has ruled.

Sheriff Norman McFadyen delivered his judgement following a six day hearing at Edinburgh Sheriff Court last month.

It will now be for Scotland’s Justice Minister, Angela Constance, to sanction the move after the law chief said there are no barriers to extradition.

The beast now faces being sent back to Utah where he will face two rape charges and a sexual assault allegation.

Rossi, 35, is also wanted by the FBI over claims he racked up a $250,000 (USD) debt on credit cards he fraudulently obtained using his step-parents' names.

Despite appeals from the sex fiend's legal team that extraditing him would be against his human rights Sheriff McFadyen ruled that he can be sent back.

Rossi wasn’t in court and attended via a video link. He sat doubled over in a wheelchair before having an outburst.

He shouted: “I’ve had a stroke and no one will help me. They have used force to bring me here.

"Norman McFadyen you are a disgrace to the legal profession.”

There was then a request by his legal team to have his attendance excused and the link was cut.

Delivering his judgment the law officer said: “I heard evidence from three medical professionals and I was satisfied all of them were credible and reliable.

“In addition, evidence was adduced from the requested person and I conclude that his evidence was unreliable and to that extent, I would not be prepared to accept any statement of fact made by him unless it was independently supported.

“He contradicted himself and of course, he continues to deny that he is Nicholas Rossi and maintains he is an Irishman adopted at birth.

“I conclude that he is dishonest and deceitful as he is evasive and manipulative."

“He has with medical professionals and in court avoided questions about his childhood and upbringing. I conclude because that is a canvas on which he has not yet chosen to paint.

“I conclude that he is dishonest and deceitful as he is evasive and manipulative.

“These unfortunate facets of his character have undoubtedly complicated and extended what is ultimately a straightforward case.

“I conclude that extradition would be compatible with the Convention rights within the meaning of the Human Rights Act 1998.

“It follows that I must send the case of the requested person Nicholas Rossi to the Scottish Ministers for their decision whether he is to be extradited.”

We told how Rossi, who used the name Arthur Knight and several other aliases, was first arrested in 2021 at a Glasgow hospital following a Covid battle.

It followed an international manhunt after a court ruled he faked his own death to avoid serious charges in America.

Rossi gave the US TV interview, broadcast in April, to refute claims he was lying about his mobility.

During the extradition held last month, Rossi gave evidence stating he couldn’t raise his arms above his head – despite him doing so on four occasions throughout the hearing in a bid to summon his lawyer.

The court also heard from his GP who said that she was "unsure" about the reasons he is using a wheelchair and told the court she believes he has "narcissistic personality disorder."

Psychiatrist Dr Kumal Chowdhary told the court that there was no evidence Rossi suffered any "acute mental illness" when he examined the sex fiend in May and that his mental health is "unlikely" to create a barrier to him being extradited.

Rossi is fighting extradition to the US over allegations of rape, sex attacks and fraud. He was nicked in a Glasgow hospital in 2021 while battling Covid and still claims he’s Irishman Knight.

But a court ruled fingerprints and tattoos prove he is Rossi.

We previously told how he was moved to solitary after causing mayhem behind bars.

Insiders say he threatened warders and riled fellow lags by making a racket at night.

Earlier this year he failed to appear in court after an alleged bust-up with security staff at the court.

It was claimed he spat at a warden before being taken to a cell.
