TikTok could face £27million fine for breaching child privacy laws on platform

TikTok could have to fork out £27million in fines after an investigation by UK authorities found it may have failed to protect children's privacy.

The ICO claims that TikTok allegedly broke UK data protection law and has served the company with a 'notice of intent', which could precede a potential fine.

The notice says an ICO investigation found that TikTok may have processed the data of children under 13 "without appropriate consent" and may have failed to provide correct information to users in "a concise, transparent way."

The ICO makes it clear that its notice does not conclusively mean that TikTok breached data protection law or that it will definitely face a fine.

Companies who breach UK data protection laws can face a fine of up to £17.5million or four percent of their global turnover, which would bring TikTok's fine up to a whopping £27million.

TikTok has been approached for comment and this story will be updated with their response.

John Edwards, the Information Commissioner, said: "We all want children to be able to learn and experience the digital world, but with proper data privacy protections. Companies providing digital services have a legal duty to put those protections in place, but our provisional view is that TikTok fell short of meeting that requirement."

TikTok has had built-in parental controls since 2020, which give parents the ability to a range of settings including a 'Safety Mode' which helps restrict what their kids can see on the app.

It also lets you set a time limit to stop your children spending too long on the app.

The app also lets you make your account private to prevent users' personal information being leaked.
