Thomas Markle Jr, 52, was stopped in Oregon, US, after appearing 'visibly intoxicated' according to police.
He was taken into custody and his car was seized.
Thomas has since apologised to his royal sister blaming medication and an argument with fiancee Darlene Blount, 38, according to the Mirror.
He said: “We were in a bar and Darlene refused to stop playing the slots. I wanted to go home as it was late but she didn’t.
“When we finally got in the car, she was furious and the row just continued from there.
“When we got home all hell broke loose. I didn’t want things to escalate so I packed up my things, put them in my truck and left.
"When the police pulled me over I said I was in agonising pain with my leg. The officer demonstrated how he wanted me to walk in a straight line.
“I told them there was no way I could. He then arrested me.”
Thomas was taken to the Grants Pass Sobering Center.
He said: “We want to be together but we need to quit drinking. I am genuinely sorry for the shame this has brought on my family and I hope they, as well as Meghan, can forgive me.”
Earlier this week, he announced is getting married to his fiancée in March – and the Duke and Duchess of Sussex are invited.
He proposed to Darlene Blount in a park close to their home in Oregon, and threw a New Year’s Eve party to celebrate them setting a date.
The couple may hold the big day in Las Vegas or Reno, and Thomas Jr hopes to dress up as Elvis and skydive into the ceremony.
He told DailyMailTV he hopes the wedding will cool tensions between Meghan and their father, Thomas Markle Snr.
He said: "Absolutely I think our wedding will bring the family closer together. It's hopeful that if Meghan and Harry came and my father – Meghan and Harry could spend some time together with him and that would be good.”
Thomas Snr is estranged from the Duchess of Sussex.
He's claimed he texts his daughter every day, but she has ghosted him and hasn't replied.
He has revealed he hopes he will be able to meet his daughter's future baby, which is due in Spring.
Thomas added: “I know in my heart I do love her and I know she loves me. She's taught me a lot I never knew about relationships and I'm sure I've taught her a few things but we've always managed to make things work.”
He was arrested on January 12, 2017, in Oregon for allegedly holding a gun to a woman's head during a drunken argument.
He was later charged with menacing, pointing a firearm at another person and unlawful use of a weapon.
According to court documents, he pointed the gun at Darlene in an attempt to get her to leave.
Meanwhile Darlene was arrested over an incident in July that allegedly left her fiancé with a black eye.
Thomas Snr, told the US tabloid website: "My son has a serious problem and he needs help, and I hope he gets it."
In December, The Sun Online exclusively shared how Meghan Markle's nephew thinks Samantha and Thomas Jr have both sold Meghan out.
Thomas Jr previously wrote an open letter in May telling Meghan to call off her wedding, branding it a “fake fairy tale”.
He told the prince in April: "It's not to late. Meghan Markle is obviously not the right woman for you."
